Terms of Sale

1. Purpose and scope
These Terms of Sale (the « Terms ») govern the sale of MyStrow software licences and any related service offered on mystrow.fr. Placing an order implies full and unreserved acceptance of these Terms. They prevail over any other document, unless otherwise agreed in writing beforehand.
The publisher reserves the right to amend these Terms at any time; the applicable Terms are those in force on the date of the order.
2. Seller
The software is published and sold by the publisher identified in the Legal Notice (sole trader — French micro-enterprise). Contact: nicolas@mystrow.fr.
3. Products and services
MyStrow is a DMX lighting control software. It is offered under the following plans:
- Free trial — full access to features for 14 days, no credit card required, excluding DMX output.
- Pro — monthly or annual subscription including full DMX output, activation on 2 machines, updates and email support.
- Lifetime — lifetime licence for a single payment, including lifetime updates and no subscription.
The essential characteristics of each plan are set out on the Pricing page. The software is licensed for personal, non-transferable use; the user does not become the owner of the software.
4. Prices
Prices are stated in euros, all taxes included (VAT not applicable, article 293 B of the French General Tax Code — small business exemption). The applicable rates are those displayed on the Pricing page at the time of the order:
- Pro — €11.99/month billed annually (€143.86/year), or €23.99/month billed monthly with no commitment;
- Lifetime — €287.99 as a single payment.
The publisher reserves the right to change its prices at any time; the applicable price is the one in force on the day of the order.
5. Order and payment
Orders are placed online. Payment is securely processed by our provider Stripe; the publisher never has access to card details. The order is confirmed as soon as payment is confirmed. A confirmation is sent by email.
6. Delivery and licence activation
As the product is entirely digital, no physical goods are shipped. The licence is activated automatically after payment: the account linked to the email address provided is immediately credited with the corresponding rights. The licence is valid on a maximum of 2 machines simultaneously.
7. Subscriptions: term, renewal and cancellation
Pro subscriptions are taken out for the chosen period (monthly or annual) and renew automatically for an identical period unless cancelled before the renewal date. You may cancel at any time from your account area or by writing to nicolas@mystrow.fr; cancellation takes effect at the end of the current period and no pro-rata refund is due for the period already started. The Lifetime licence is not a subscription and does not renew.
8. Right of withdrawal
Under articles L221-18 et seq. of the French Consumer Code, consumers have 14 days to withdraw from a distance purchase, without giving reasons.
Exception — digital content: pursuant to article L221-28 13° of the French Consumer Code, by purchasing and downloading/activating the software, the customer expressly requests immediate performance of the service and acknowledges waiving the right of withdrawal as soon as performance begins (download or licence activation).
The 14-day free trial allows you to evaluate the software with no commitment before any purchase.
9. Legal guarantees
Consumers benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). To invoke these guarantees, contact nicolas@mystrow.fr.
10. Liability
The software is provided « as is ». The publisher does everything possible to ensure it works properly but cannot be held liable for indirect damages, nor for malfunctions related to the user's hardware, network environment, third-party DMX equipment or non-compliant use. Users are solely responsible for the configuration and safety of their lighting installation.
11. Fixture library and user contributions
11.1 — Purpose. MyStrow provides its users with a library of lighting fixture profiles, that is, the technical description of the DMX channel layout of a fixture. The software allows users to import profile files and, optionally, to submit the resulting profile to the shared library accessible to other users (the « Contribution »).
11.2 — Optional nature. Submitting a Contribution is strictly voluntary and never automatic. An imported profile remains usable locally, on the user's own machine, whether or not it is submitted for sharing. Declining to contribute in no way affects access to the software or to the services purchased.
11.3 — User representations and warranties. By submitting a Contribution, the user represents and warrants:
- that they are the author of the profile concerned, or that they hold the rights or licence allowing them to authorise its distribution;
- that the origin they declare in the software is accurate and given in good faith;
- that the Contribution does not infringe any third-party right, in particular copyright, database producer rights, trade mark rights or trade secrets.
The user indemnifies the publisher against any claim, action or award resulting from a breach of these representations.
11.4 — Sources excluded from sharing. The following may under no circumstances be submitted for sharing:
- profile files supplied by a hardware manufacturer and subject to a licence or terms of use that do not permit redistribution;
- files obtained from platforms whose terms of use do not permit redistribution, in particular GDTF Share;
- any file whose origin is unknown to the user.
The software technically blocks these origins: the profiles concerned remain in the user's local library and are not transmitted. Any attempt to circumvent this control constitutes a breach of these Terms and may result in suspension of the account.
11.5 — Licence granted to the publisher. By submitting a Contribution, the user grants the publisher, free of charge, on a non-exclusive basis, worldwide and for the legal term of protection of the rights, the right to reproduce, adapt, translate, convert into any format, incorporate and distribute that Contribution to MyStrow users, for the sole purposes of operating the software and its services. The user retains all rights in their Contribution and remains free to use, publish or assign it elsewhere.
11.6 — Data transmitted. Only the technical description of the DMX patch is transmitted: fixture name, manufacturer, type and ordered list of channels. The original file is neither transmitted, nor stored, nor redistributed, and no images (gobos, product visuals, logos) are collected. For traceability and for handling reports, the contributing account identifier, its email address, the date of submission and the declared origin are associated with the Contribution.
11.7 — Attribution and open source licences. Contributions originating from open libraries are distributed with the mention of their source and original licence preserved, in particular the CC0 1.0 licence for Open Fixture Library data and the Apache 2.0 licence for the QLC+ library. These notices must not be removed.
11.8 — Moderation. No Contribution is published automatically. Every submission is reviewed beforehand and the publisher reserves the right to accept, refuse, correct or subsequently withdraw it, without having to justify its decision and with no guaranteed processing time. This moderation capability does not create any general obligation for the publisher to monitor content. Contributions give rise to no remuneration, consideration or price reduction.
11.9 — Trade marks and compatibility. Manufacturer and fixture model names are used for the sole purpose of identifying the hardware a profile is compatible with, which constitutes a use necessary for interoperability. These signs remain the property of their respective owners. Their presence in the library implies no partnership, sponsorship, approval or affiliation between the publisher and the manufacturers concerned.
12. Reporting and removal of content
With regard to Contributions uploaded by its users, the publisher acts as a hosting service provider within the meaning of article 6 of French Act No. 2004-575 of 21 June 2004 on confidence in the digital economy and of Regulation (EU) 2022/2065 on digital services.
Any rights holder or interested third party may report content they consider unlawful to nicolas@mystrow.fr, stating the fixture concerned (manufacturer and model), the grounds for the report and the evidence of their standing to act.
Any sufficiently substantiated report is reviewed and, where appropriate, leads to the removal of the content from the shared library as soon as possible.
A user who has submitted a Contribution may request its removal at any time at the same address. Removal applies to the shared library; it cannot reach copies already downloaded by other users onto their own machines before that removal.

14. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Under articles L611-1 et seq. of the French Consumer Code, consumers have the right to use a consumer mediator free of charge to settle the dispute amicably. Consumers may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
